New Federal Online Gaming Rules Take Effect to Target Money Games and Support E-Sports

New Delhi: The Promotion and Regulation of Online Gaming Rules, 2026, officially came into force on Friday, marking a significant milestone in the oversight of the country’s digital entertainment landscape. These rules establish a comprehensive framework designed to govern the online gaming sector with a dual focus on ensuring consumer safety and facilitating legitimate industry expansion. This move represents a transition from general policy objectives to a strictly enforceable regulatory regime. The new rules are rooted in the Promotion and Regulation of Online Gaming Act, which was passed by Parliament in August 2025 to address the growing social and financial concerns associated with online money gaming while simultaneously encouraging the development of e-sports and social gaming platforms.

The new legal framework imposes a comprehensive ban on all forms of online money games, regardless of whether they are classified as games of skill or games of chance. This prohibition extends to the advertising, promotion, and facilitation of such activities, with financial institutions and payment gateways now strictly barred from processing any transactions linked to prohibited platforms. To ensure the rules are followed, authorities have been empowered to block unlawful websites under existing information technology legislation. This rigid stance aims to protect the public from the risks of financial loss and social harm while providing a clearer path for the growth of non-monetary digital gaming sectors.

India’s online gaming market has seen rapid expansion, generating approximately 232 billion rupees in 2024, with a vast majority of that revenue previously derived from transaction-based gaming models. With the sector projected to reach a value of 316 billion rupees by 2027 through a consistent growth rate, the federal government intends to pivot this momentum toward innovation and creativity. By distinguishing between prohibited money-based activities and permissible e-sports or social games, the new regulations aim to foster a global gaming hub that prioritizes user trust and provides a predictable environment for legitimate stakeholders.

Compliance with the new standards is backed by stringent penalties intended to deter illicit operations. Individuals or entities found offering or facilitating prohibited money games could face up to three years of imprisonment or a fine of up to 10 million rupees. Repeat offenders will be subject to a minimum of three years in jail, which could be extended to five years depending on the severity of the breach. Furthermore, those involved in advertising these illegal games could face up to two years of incarceration. Enforcement will be handled by specialized cyber cell officers at the station, district, and commissionerate levels, ensuring a multi-tiered approach to maintaining the integrity of the digital economy.
