Delhi High Court Declines PIL Seeking NIA Probe Into CJP’s ‘Chalo Sansad’ March

New Delhi: The Delhi High Court on Friday refused to entertain a Public Interest Litigation (PIL) seeking an investigation by the National Investigation Agency (NIA) or another specialized agency into the Cockroach Janata Party-led (CJP) ‘Chalo Sansad’ march held on July 20. The division bench, comprising Chief Justice D.K. Upadhyaya and Justice Tejas Karia, observed that deciding whether to transfer an investigation to the NIA falls within the statutory domain of the Central Government, emphasizing that the court cannot substitute its own satisfaction for that of executive authorities.

The bench noted that the alleged incidents of vandalism and public disruption during the NEET-UG paper leak protest were already within the knowledge of law enforcement and administrative authorities. The court highlighted that relevant authorities remain fully empowered to take appropriate legal action in accordance with statutory procedures. Following these judicial observations, Solicitor General Tushar Mehta advised the petitioner’s counsel to withdraw the plea, leading the court to dismiss the petition as withdrawn.

The PIL, filed by former Akhil Bharat Hindu Mahasabha office-bearer Satish Kumar Aggarwal, had alleged potential external influence and requested a specialized probe into the July 20 demonstration near Parliament. The court’s refusal to intervene leaves any decision regarding central agency involvement entirely to executive discretion while existing law enforcement procedures continue.
