Supreme Court Upholds Bail Cancellation for Accused in Deadly 2025 Goa Nightclub Fire

New Delhi: The Supreme Court on Monday dismissed petitions challenging a Bombay High Court decision that revoked the bail granted to three individuals accused in the fatal 2025 Goa nightclub blaze, which killed 25 people and injured 50 others.

A bench comprising Justices Dipankar Datta and Sheel Nagu ordered the nightclub owners, Saurav Luthra and Gaurav Luthra, alongside their business partner Ajay Gupta, to surrender to authorities within two weeks. The top court also directed the lower court to expedite the trial proceedings in the matter.

The case stems from a massive fire that broke out on December 6, 2025, at the Birch by Romeo Lane nightclub in Arpora, North Goa. The establishment was operated by M/s Being GS Hospitality Arpora LLP, a partnership involving the Luthra brothers and Gupta. While a trial court granted bail to the trio in April, the Goa state government subsequently challenged that relief before the Bombay High Court.

On August 18, the Bombay High Court set aside the trial court’s decision, ruling that the lower court had failed to adequately assess the investigative material and had erred in concluding that the offence was not as severe as offences such as murder or dacoity. The High Court further highlighted that records showed the venue was an unauthorised structure functioning without valid licences, adding that the operators allegedly proceeded with indoor fire displays despite being aware of the severe safety hazards.

With the Supreme Court refusing to intervene in the High Court’s ruling, all three accused must now surrender before the sessions court as directed to face trial.
