New Zealand Changes Skilled Migrant Rules, Offering Relief to Punjabi Workers in Trades and Construction

Auckland: New Zealand has introduced revised rules for skilled migrants, with changes to residence pathways expected to provide greater certainty for workers already employed in the country, particularly those working in trades, construction, technician roles and other hands-on occupations.

Immigration New Zealand (INZ) has finalised the operational guidelines for changes to the Skilled Migrant Category Resident Visa and related work-to-residence pathways. The revised settings came into effect on August 24.

The changes are likely to attract considerable attention among Punjabi migrants working across New Zealand’s construction, manufacturing, dairy, technical and trade sectors.

One Wage Threshold Instead of Two

One of the key changes concerns the wage requirement for Skilled Migrant Category applicants.

Under the revised system, most applicants will generally have to meet the wage threshold that was applicable when they began accumulating their qualifying skilled work experience in New Zealand. They will not normally be required to meet a higher threshold that may have come into effect by the time they apply for residence.

INZ has also introduced a five-month grace period in certain circumstances. If the applicable wage threshold increases after a migrant receives a visa but before they start the relevant employment, the previous threshold can continue to apply during the grace period.

The change is designed to reduce uncertainty for migrants whose eligibility could otherwise be affected by changes in wage thresholds while they are progressing towards residence.

New Rules for Qualifications

The immigration authority has also changed the documentation requirements for applicants seeking points based on higher-level qualifications.

Applicants claiming points for Level 8 or Level 9 qualifications will generally need to demonstrate that they also hold a relevant bachelor’s degree or an equivalent qualification. They will also have to submit supporting certificates and academic transcripts.

An exception has been made for applicants claiming five points for a New Zealand master’s degree.

Trades and Technician Pathway Gets Adjustment

The revised Trades and Technician pathway is particularly significant for workers in occupations linked to construction, manufacturing and other skilled industries.

One previous requirement relating to overseas qualifications has been removed. Applicants will no longer have to demonstrate that their overseas qualifications contain 120 credits.

For New Zealand qualifications, however, the 120-credit requirement remains. Applicants can combine more than one related qualification where necessary to reach the required total.

The adjustment could make the pathway more accessible to skilled workers whose professional training has been obtained outside New Zealand.

Self-Employment No Longer Counts

Another important change is the treatment of self-employment.

Work undertaken through self-employment will no longer be accepted as directly relevant skilled work experience under the new Trades and Technician and Skilled Work Experience pathways.

This means applicants relying on these routes will need to carefully assess whether their employment history meets the revised definition of qualifying skilled work.

Stronger Checks on Job Offers

INZ has also tightened the requirements surrounding skilled employment.

Under the revised settings, job offers used to support an application must be available and ongoing. Employers must also be able to demonstrate that there is a genuine requirement for the position to be located in New Zealand.

The change is intended to ensure that residence applications are supported by genuine employment rather than positions created primarily for immigration purposes.

Changes Extend to Other Residence Pathways

The simplified wage arrangements and five-month grace period are not limited to the Skilled Migrant Category.

Similar arrangements will also apply to the Work to Residence, Care Workforce and Transport Work to Residence visa pathways.

For migrants already employed in New Zealand, the changes could offer greater predictability as they work towards meeting residence requirements.

What It Means for Punjabi Migrants

New Zealand’s revised immigration settings could be particularly relevant for Punjabi workers employed in construction, trades, technical occupations, manufacturing, dairy and related industries.

Workers with New Zealand qualifications and those considering the new Trades and Technician pathway may also benefit from the changes, although eligibility will depend on individual qualifications, occupation, employment history, wages and other visa requirements.

Immigration New Zealand has advised prospective applicants to review the latest eligibility criteria and documentation requirements before submitting an application, as meeting one condition alone does not guarantee approval for residence.
