High Court Orders CBI Probe into Alleged Bribery Involving Advocate, Judicial Officer in Chandigarh

Chandigarh: In a case that raises serious concerns over legal and judicial integrity, the Punjab and Haryana High Court has ordered a Central Bureau of Investigation (CBI) probe into allegations that a practicing advocate accepted Rs. 5 lakh from a litigant under the pretext of bribing a judicial officer and a government pleader.

Justice Sandeep Moudgil, while passing the order, cited the “seriousness and sensitivity” of the matter, noting that it not only involved accusations of financial misconduct but also potential threats to the petitioner’s safety and the credibility of the judicial system itself.

“Given the complexity and sensitivity of the issues… and the questions raised regarding the integrity of one of the most vital pillars of democracy, i.e., the judicial institution, an impartial investigation by an independent agency like the CBI is essential,” the Court observed.

Background of the Case

The matter arose from a protection plea filed by the advocate, who alleged that he was being threatened by a former Sarpanch (village head) after the legal outcome of a case did not meet the latter’s expectations. According to the advocate, the former Sarpanch was demanding a refund of professional fees, accompanied by alleged intimidation.

During the proceedings, however, the narrative took a sharp turn. The Chandigarh Police, while recording a statement from the ex-Sarpanch, noted that he accused the advocate of soliciting money under the pretense of bribing a government pleader and a judicial officer. The payments were reportedly made in installments, with at least one transfer alleged to have been made via Google Pay.

Allegations Lack Specifics, Yet Raise Red Flags

While the ex-Sarpanch’s statement did not include the names of the government or judicial officials allegedly involved, the Court underscored that the nature of the claims was severe enough to merit an in-depth, independent inquiry.

“The allegations made are extremely serious, touching upon the professional ethics of the legal community and the integrity of judicial processes,” the Court stated, adding that such matters strike at the very foundation of public trust in the justice system.

CBI Tasked with Thorough Investigation

Justice Moudgil directed the CBI to take immediate cognizance of the complaint and begin a detailed investigation into all aspects of the case, including potential misconduct by public officials and misuse of professional privilege by the advocate.

The agency has also been instructed to file a comprehensive report within a fixed timeline, though the Court has not publicly disclosed the deadline to ensure investigative independence.

Legal experts say the Court’s decision underscores the need for higher accountability and ethical vigilance within the legal profession. It also reinforces the judiciary’s role in self-correcting when allegations, even if unproven, threaten the institution’s credibility.
